DMCA and Intellectual Property Notice

1. Ownership of platform content

All content on www.caretcare.com and the Caret Care platform, including lesson content, document templates, checklists, the structure and sequencing of the program, generated document designs, graphics, branding, and the Caret Care name and mark, is owned by Caret Care, Inc. or its licensors and is protected under United States copyright, trademark, and other intellectual property law. Unauthorized reproduction, distribution, public display, or creation of derivative works from this content is prohibited and may result in account termination and legal action, as described in our Acceptable Use Policy and Terms of Use.

2. What your license covers

An active Caret Care membership licenses platform content for your individual use in building and operating your own practice. Documents you generate using your own practice information are yours to use with your own clients. The underlying template design, language, and structure remain the property of Caret Care, Inc., and no membership transfers ownership of any platform content. 3. Reporting infringement

Caret Care respects the intellectual property rights of others and expects the same in return. If you believe content appearing on the platform infringes a copyright you own or control, you may submit a notification under the Digital Millennium Copyright Act (DMCA) to our designated agent listed below. If you believe Caret Care content is being reproduced or distributed without authorization elsewhere, we also ask that you report it to the same address.

4. Filing a DMCA notice

To be effective under 17 U.S.C. § 512(c)(3), your notification must include: (a) a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material claimed to be infringing, with information reasonably sufficient to permit us to locate it; (d) your contact information, including address, telephone number, and email address; (e) a statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law; and (f) a statement, made under penalty of perjury, that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner.

Knowingly misrepresenting that material is infringing may expose you to liability under 17 U.S.C. § 512(f).

5. Counter-notification

If material you posted was removed in response to a DMCA notice and you believe the removal was mistaken or the material was misidentified, you may submit a counter-notification to the designated agent containing: your physical or electronic signature; identification of the removed material and its prior location; a statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification; and your name, address, and consent to the jurisdiction of the federal district court for your judicial district (or, if outside the United States, the jurisdiction in which Caret Care may be found).

6. Repeat infringers

Caret Care will terminate the accounts of members determined to be repeat infringers in appropriate circumstances.
